We are a fully licensed and insured electrical contractor, committed to compliance with all relevant Australian laws, regulations, and safety standards. These Terms outline the conditions under which we offer our services, the expectations for both parties, and important disclaimers and legal protections. Services: Nexa Electrical Solutions offers a range of electrical services, including but not limited to: installing electrical fixtures and wiring, repairing and maintaining electrical systems, upgrading switchboards, safety inspections, and emergency electrical call-outs at any hour. The specific services to be provided will be detailed in our job agreement, quote, or confirmation for each project. We will perform all services with due care, skill, and diligence consistent with good industry practice and in accordance with applicable Australian Standards and regulations (for example, the AS/NZS 3000 Wiring Rules and state electrical safety legislation).
Service Areas: Our services are available in designated areas of NSW and QLD. We will inform you at the time of booking if your location is within our service range. While we strive to accommodate all requests, factors such as distance, availability of technicians, or jurisdictional licensing constraints may limit where or how we provide services.
Scope of Work: Prior to commencing any job, we will usually provide you with a scope of work (in the form of a written quote or description) outlining the tasks we will perform, any materials to be supplied, and the price or rate for the job. The work we perform will be limited to that scope unless you request additional services. Should you require any changes or extra work, variations can be arranged by mutual agreement, and note that this may result in additional charges or a revised completion timeline.
Site Requirements: You agree to provide safe and reasonable access to your property or premises so that we can perform the electrical work. This includes ensuring that the work area is free from obstructions and hazards, that all necessary permissions (for example, building management approval if required in apartments or commercial buildings) have been obtained, and that an adult authorized to make decisions is present during the service if needed. If there are any known safety risks (such as asbestos, live exposed wiring, etc.), you must inform us in advance. We reserve the right to refuse or suspend work if our electricians believe conditions are unsafe or if information provided is inaccurate, in which case we will discuss alternative arrangements or remedies with you.
Permits and Regulations: Where certain electrical work requires notification to or permits from regulatory authorities (such as obtaining an electrical works certificate or inspection by a regulator), Nexa will handle the required compliance steps if it is part of the agreed scope. We ensure that all work is done by qualified personnel holding the necessary licences for NSW and QLD. You agree that you will not request us to perform any unlawful or non-compliant task. We will not be responsible for any delay in services caused by waiting for third-party approvals or utility company shutdowns that are outside our control, but we will keep you informed and do our best to minimise any disruption.
By requesting or using our services, you confirm that: (a) you are at least 18 years old and legally capable of entering into a binding contract, or you are a duly authorised representative of a company or organisation for which you are ordering services; and (b) the information you provide to us is accurate, complete, and up-to-date.
If you are engaging our services on behalf of another person or an entity (for example, you are a property manager booking on behalf of an owner or tenant), you warrant that you have the authority to do so and to bind that person or entity to these Terms. You must ensure any persons benefiting from or present during our service (e.g. other residents at a job site) are aware of relevant obligations and safety requirements.
Nexa reserves the right to decline or cancel a service request if these eligibility conditions are not met, if we suspect unauthorised or fraudulent activity, or for any other reason at our sole discretion (such as inability to perform the service safely or legally). In such cases, we will promptly inform you and, if applicable, provide a refund for any payment for services not yet rendered.
Quotations: We are happy to provide you with a quotation or estimate for requested work. Quotes may be given after an on-site assessment or based on information you provide via phone/email. All quotations are valid for a limited period (for example, 30 days) as stated on the quote, because prices of materials or scheduling availability can change. A quote outlines the expected costs for the described scope of work, but please note that if the information provided was incomplete or circumstances change, the actual work required (and thus cost) might vary. We will always discuss with you and seek your approval before proceeding with any work that would incur costs beyond an approved quote.
Bookings: When you accept a quote or request a service, we will schedule a booking at a mutually agreed date and time. Bookings can be made via our website form, by email, or over the phone. Once a booking is confirmed, we will send you a confirmation (usually via email or SMS) detailing the appointment and any preparation needed. We strive to arrive on time for all appointments; however, please allow for reasonable delays due to traffic, prior jobs taking longer than expected, or other unforeseen factors. We will communicate with you as early as possible if there is any significant delay or need to reschedule. You also agree to be available at the scheduled time or to have an authorized person present to grant access. If no one is present when we arrive at a confirmed booking, we may not be able to complete the service and a call-out fee or cancellation charge may apply.
Cancellations & Rescheduling: We understand that schedules can change. If you need to cancel or reschedule a booking, please contact us as soon as possible (at least 24 hours in advance of the appointment is appreciated). Cancellations or reschedule requests made with sufficient notice will generally not incur any fees. However, for cancellations made at very short notice (for example, on the day of the booking) or if you fail to be present at the agreed time, we reserve the right to charge a reasonable cancellation fee or call-out fee to cover the time and travel costs of our electrician. We will always consider the circumstances in good faith before applying any charge. Likewise, if we need to reschedule (due to technician illness, emergency conflicts, or other reasons), we will notify you promptly and arrange an alternative time that suits you as closely as possible. Any deposits or prepayments you have made for a cancelled service will be refunded if the cancellation is due to our change of plans or if you cancelled within any agreed free cancellation period.
Pricing: Our prices for services are generally provided upfront in the form of a quote or set rate. All pricing is in Australian Dollars (AUD) and, unless stated otherwise, includes Goods and Services Tax (GST) as required by law. We aim to be transparent with our fees. If a job is likely to incur additional charges (for example, if unforeseen complications arise or if you request extra work on-site), we will explain the reasons and get your approval for any additional costs before proceeding further. Standard rates may differ for after-hours emergency work versus scheduled work during normal business hours, and any minimum call-out charges or special surcharges (e.g., for remote locations or public holidays) will be clearly communicated to you prior to booking.
Deposits: For larger projects or custom orders requiring significant materials, we may require a deposit or partial upfront payment. The need for and amount of any deposit will be specified in your quote or at the time of booking. Deposits are generally non-refundable if you cancel the job after we have committed resources or turned away other work for that scheduled time, except at our discretion or if required by law.

Payment Timing: Unless otherwise agreed, payment is due at the completion of the job or as per the terms stated on the invoice. For smaller jobs, our technician may request payment immediately after the work is done (we will issue or email you an invoice/receipt). For larger projects, the payment schedule (such as deposit, progress payments, and final payment) will be outlined in the service agreement or quote. If an invoice is issued with a due date, you must pay by that date (typically within 7 or 14 days of invoice, as indicated). Timely payment is essential to avoid disruption of any ongoing services and to maintain good standing.
Late Payments: If you do not pay an invoice by the due date, Nexa reserves the right to charge interest on the overdue amount at a reasonable rate (for example, the rate prescribed under applicable law for late payments or a rate reflecting our cost of funds) from the due date until payment is received in full. We may also suspend any further services or refuse new requests until outstanding amounts are settled. In the unlikely event that an invoice remains unpaid for an extended period, we may engage a debt collection agency or take legal action to recover the debt. You agree to indemnify us for any costs we incur in recovering overdue payments (to the extent permitted by law), including collection agency fees and legal fees on a solicitor-client basis. We will provide notice and reasonable opportunity to cure any payment default before escalating to such measures.
We issue official tax invoices for all work completed, in compliance with Australian tax requirements. Invoices will detail the services provided, the date of service, a breakdown of costs (labour, parts/materials, call-out fee if any, GST, etc.), and our business details (including ABN). If you require any specific information on the invoice (for example, a purchase order number or reference, or billing to a company name), please inform us when booking or before the job is finalized.
Invoices are typically provided in electronic form (via email) to the email address you supplied. If you prefer a paper invoice or an alternate delivery method, let us know and we will accommodate where possible. By using our services, you consent to receive invoices and receipts electronically.
Please check your invoice upon receipt and contact us promptly if you have any questions or believe there is an error. We value transparency and will gladly explain the charges. If any adjustments are needed due to a mistake on our part, we will correct the invoice and, if necessary, issue a refund or credit.

Statutory Guarantees: Importantly, the above warranty is in addition to any rights and remedies you may have under the Australian Consumer Law (ACL) or other applicable laws. General Liability Limitation: To the maximum extent permitted by law, Nexa Electrical Solutions (and its directors, employees, contractors, and agents) shall not be liable for any indirect, incidental, special, or consequential loss or damage whatsoever arising out of or in connection with our services, the use or inability to use our website, or these Terms. This includes, without limitation, damages for loss of profits or revenue, loss or corruption of data, loss of opportunity, loss of goodwill, or damage to property, arising from any cause of action in contract, tort (including negligence), strict liability or otherwise.
Direct Damages: To the extent we are found liable for any claim under these Terms, our liability is limited (at our election) to either: (a) the resupply of the relevant services, or (b) the cost of resupplying those services. In the context of website use or free information we provide, our total liability will be zero or the minimum amount permitted by law since you have not paid for such use. For paid services, this cap of liability will not exceed the amount you paid to us for the specific service giving rise to the claim. These limitations apply to the fullest extent permitted by law.
No Liability for Delays or Events Beyond Our Control: While we endeavour to meet all schedules and deadlines, Nexa is not liable for any delay or failure to perform that is caused by circumstances beyond our reasonable control. This includes but is not limited to natural disasters, extreme weather events, power outages, internet or telecommunication failures, strikes, war, pandemic restrictions, governmental actions, or any other force majeure event. If such circumstances occur, we will communicate with you as soon as possible and make appropriate arrangements (such as rescheduling services), but we will not be responsible for any related loss or damage you may incur due to the delay or failure.
Consumer Law: Nothing in these Terms of Service is intended to exclude or restrict any legal rights or remedies you may have under the Australian Consumer Law or other applicable legislation. If any provision of these Terms is determined to be illegal, invalid, or unenforceable under law, that provision will be severed or limited to the minimum extent necessary, and the remainder of the Terms will remain in full force and effect.
Consequential Damage Exclusion: In line with the above, we explicitly exclude liability for any damage to appliances, equipment, or property that is not directly caused by our negligence. For example, if we turn off power as part of our work, we are not liable for losses caused by the temporary loss of electricity (such as food spoilage or business interruption), except to the extent required by law. However, if our negligence directly causes damage (for instance, a tool drops and damages a floor), we will take responsibility to the extent of repair or compensation as appropriate and required by law. We maintain appropriate insurance coverage (including public liability insurance) to provide peace of mind for such incidents, and we will cooperate in good faith to resolve any legitimate claim.

In any case, we operate under the consumer protection and trade laws enforced in the location where the service is provided (including the Australian Consumer Law).
By using our services, you submit to the jurisdiction of the courts of the state in which the service was performed (for example, NSW courts for work done in NSW, and QLD courts for work done in QLD) and the relevant Australian courts for the resolution of any legal disputes. If a dispute relates to the use of our website or these Terms generally (and not to a specific service performed at a location), then you agree that the courts of New South Wales (and courts that hear appeals from them) will have exclusive jurisdiction to adjudicate that dispute.
